Calendar with deadline mark

Hurricane Michael: Warning! Three Year Notice Deadline to file Hurricane Michael Claims runs out Oct 10th

October 10th, 2021 will mark the three-year anniversary of Hurricane Michael’s landfall in the Florida panhandle near Panama City, bringing with it maximum sustained winds of 160 mph and a minimum pressure of 919 millibars. In addition to marking the anniversary of the event, October 10th this year is also the Notice Deadline to file Hurricane Michael Claims.

If your home or property was in an area that was potentially impacted by Hurricane Michael, you need to speak to an expert who can inspect your property before October 10th. Please feel free to reach out to our law firm for recommendations on trusted experts that can perform these inspections, often at no cost.

Florida law provides Florida homeowners and businesses up to 3 years in which they are able to provide notice to their insurance company regarding any hurricane or windstorm damage that may have occurred on the insured property. The relevant statute, FL 627.70132, is also called “Notice of windstorm or hurricane claim.” This statute of limitations applies to both new claims as well as supplemental and reopened claims. The 3-year statute of limitations is a hard deadline to file any type of claim related to property damage caused by wind or hurricanes.

If you already filed a claim for damage from Michael, October 10th is also important to keep in mind as the deadline to file claims for any supplementary (additional) damage or to reopen a closed claim. Over the years we have encountered many homeowners who filed claims on their own which were either underpaid or denied. For many of these homeowners, it was their first experience filing a claim and they accepted the insurer’s first offer, often to their detriment when their claim was denied or underpaid. For the vast majority of these denied and underpaid claims, we were able to get the homeowners compensated for the full extent of their damage, or their wrongfully denied claim overturned.

If you have already filed a claim and it was underpaid or denied, we strongly recommend speaking to an insurance claims attorney who can evaluate the facts of your case and advise you on whether the outcome of the claim was fair. At Tighe P.A., we are happy to offer all Florida residents who made a claim for Hurricane Michael damage a free Hurricane Michael Claim Review where we will evaluate the damage, the claim, and the settlement to make sure that you were provided a fair settlement based on the damage that occurred.
